Rule 62 – Exchange of written pleadings (action for declaration of non-infringement)
  1. The written procedure shall consist of:
    1. the lodging of a Statement for a declaration of non-infringement (by the claimant) [Rule 63];
    2. the lodging of a Defence to the Statement for a declaration of non-infringement (by the defendant) [Rules 67 and 68]; and, optionally
    3. the lodging of a Reply to the Defence to the Statement for a declaration of non-infringement [Rule 69];
    4. the lodging of a Rejoinder to the Reply [Rule 69].
  2. Rule 12.5 shall apply.
